Terms and Condition:

1. Acceptance of Terms

State that by using the site, the user agrees to these rules.

  • Draft: "By accessing cdlrightnowstudy.com, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions."

2. Educational Disclaimer (Crucial for CDL)

Since you are not currently a registered ELDT provider, you must be clear about what your site is and is not.

  • No Guarantee of Passing: "While our materials are designed to help you prepare, we do not guarantee that you will pass the state CDL exam."

  • Not an FMCSA Provider: "CDL Right Now Study is a supplemental educational resource. We are not a registered Training Provider (TPR) under the FMCSA ELDT mandate. Completion of our modules does not satisfy federal theory or behind-the-wheel requirements."

3. User Accounts & Security

  • Individual Use: "Accounts are for a single user only. Sharing login credentials with third parties is strictly prohibited and may result in account termination without a refund."

  • Responsibility: Users are responsible for maintaining the confidentiality of their passwords.

4. Intellectual Property

Protect your hard work.

  • "All content, including text, graphics, and practice exams, is the property of CDL Right Now Study. You may not copy, redistribute, or sell any materials found on this site without express written permission."

5. Subscription & Payment Terms

If you offer "Unlimited Access" for a fee:

  • Billing: "Subscriptions are billed [monthly/annually] and will automatically renew unless cancelled through your account settings."

  • Refund Policy: "Due to the digital nature of our products, all sales are final. Refunds are only issued in cases of technical failure on our end that prevents access for more than 48 hours."

6. Limitation of Liability

Protect yourself from "consequential" damages (like a driver losing a job because they failed a test).

  • "CDL Right Now Study shall not be liable for any direct or indirect damages, including loss of income or employment, resulting from the use or inability to use our materials."

7. Governing Law

Specify which state’s laws apply to the contract.

  • Example: "These terms shall be governed by and construed in accordance with the laws of the State of [Your State]."
